TWO TOTAL CITES required (-10 for each one not included), but more citations are welcome. You may use either MLA or APA format. Please use an in-text citation and create a works cited for the bottom of your post. These are not questions you can simply answer off the top of your head without reading the chapter and doing outside research. The relevant pages of Chapter 5 for this assignment are pp. 173-76.
Affirmative action (which opponents sometimes label as “reverse discrimination”) remains a controversial topic in American politics and American life. Before you move forward, please watch this short video explaining affirmative action in our country: (Really, watch it. There might be an exam question from this!)
The topic of race as a consideration in “hiring” has been in the news recently as President Biden kept a campaign promise made in 2020 specifically to appoint a Black woman to the United States Supreme Court while in office. Last week, he announced his nomination of Judge Ketanji Brown Jackson from the D.C. Court of Appeals as his choice to replace the retiring Associate Justice Stephen Breyer. As you recall from your study of the Supreme Court, this is a historic moment. She will be the first Black woman appointed to the 9-member Supreme Court. As the justices serve for life, turnover is very low and not every president has an opportunity to appoint a justice (Trump was able to appoint 3 justices, which is VERY unusual).
Affirmative action is defined by your textbook as “government policies or programs that seek to redress past injustices against specified groups by making special efforts to provide members of those groups with access to educational and employment opportunities” (Ginsberg et al., 2021, p. 173). One argument against affirmative action is that it disrupts a system of merit so that less-qualified applicants who represent racial minorities are selected over more qualified individuals. In fact, Texas Senator Ted Cruz has made this very argument against President Biden’s choice to reserve his appointment for a Black woman without considering other qualified candidates from different backgrounds. Watch what Cruz said in an interview on FOX news about this appointment (approx. 2 mins): One take away from his comments: “What the president said is that only African American women are eligible for this slot, that 94% of Americans are ineligible,” Cruz told “Fox News Sunday. … The way Biden ought to do it is to say, ‘I’m going to look for the best justice,’ interview a lot of people, and if he happens to nominate a justice who was an African American woman, then great” (Ankel, 2022). Cruz is not alone in his criticism.
You should answer the following two questions in a well-written response of no less than 350 words. Your initial response is due by Friday, March 4th at 11:59 p.m., and two replies of no less than 100 words each are due by Sunday, March 6th at 11:59 p.m. Where possible, you should respond to at least one classmate who disagrees with you.
Is affirmative action ever justified (in employment, college admissions, etc.) because a system of preferences operated for much of American history in which qualified white applicants were always preferred over equally qualified black applicants? (Be sure to check WTP for this question!)
After considering the issue, including reading the textbook and looking at outside sources, do you support Biden’s campaign promise and ultimate nomination of a Black woman to the Supreme Court? Or, do you agree with Senator Cruz or other critics? Explain your answer.
