You work in a Law Centre and you have been given a number of case files to assess.
Prepare a report for your manager, outlining the legal issues in each case and whether, in
your opinion, the cases are likely to succeed. You must support your opinions with
reference to the relevant provisions of the Equality Act 2010 and case law.
Brenda, Mercy and Priti
Brenda, Mercy and Priti are employed by Culrain City Council as home care
workers, trained to provide personal care to the elderly in their own homes. They have
discovered that they get paid significantly less per hour than the men employed by the
council as road sweepers. The men have told the women that they get paid more as
there is a collective agreement covering skilled manual work, which includes road
sweepers. The council have told the women that in effect they get paid the same as the
road sweepers as the women claim a mileage allowance, which boosts their take home
pay considerably. Brenda, Mercy and Priti would like to bring an equal pay claim, with the
men as their comparators.
Raheem is currently in the final year of his LLB. He wears his hair in a long natural Afro
style and has a tattoo of his favourite football team on his lower arm. He was recently
interviewed for a training contract by Great Lawyers, a large Law firm. He was invited
back for a final interview where he was told that he should change his long afro hair for a
more professional hair style, rather than looking like a “scruffy young student”. In addition,
it was made clear that the firm did not approve of the ‘modern fashion’ for tattoos.
Raheem did not change his hair or his tattoo and he was not offered the training contract.
Raheem wonders whether he has a claim for race and age discrimination against Great
Joe works at Thompson & Lawson, a public relations company. Joe has a stammer.
Recently, a senior member of the company decided to have a go at being a social media
star. His TikTok video, making fun of Joe’s stammer, went viral. As a result Joe’s
stammer has also become the subject of office jokes Joe is very upset by this and he
raised the matter with the company’s senior partner. Instead of being sympathetic, it was
made clear that no action would be taken against the video maker as being a hit on
TikTok was ‘good PR’ for the company. Joe would like to bring a claim for disability
discrimination and harassment against Thompson & Lawson.
